carefully. Its provisions set out the rights and obligations of you
and the other persons included in your party towards Fontana Travel
and Fontana Travel’s rights and obligations to you and your party.
1. Our Role
Fontana Travel is a registered Tour Operator.
All prices quoted are approved by the Croatian Ministry of Tourism
authority and include a booking fee payable to Fontana Travel but do
not include local Tourist Tax.
All accommodation used by Fontana Travel is categorised by the local
Croatian Tourist Board authority.
Fontana Travel is within its rights to implement Force Majore
therefore is not liable for circumstances caused by conditions
beyond its control, including natural disasters, riots, strikes,
acts of terrorism, sanitary disruption, civil unrest, restrictions
by local authorities.
2. Website Information
Fontana Travel has taken the greatest care to provide accurate
and truthful information on its web site. Fontana Travel guarantees
that all information is truthful and accurate at time of publishing.
All images of Villas and facilities are displayed in good faith and
are accurate representations of services provided. Fontana Travel
cannot accept responsibility for changes made to property inside or
out by village accommodation owners nor can accept responsibility
for changes made to excursions provided by local operators. In the
unfortunate event of excursions being cancelled in conditions beyond
the control of Fontana Travel, all moneys paid for excursions will
be refunded no later than 30 days of departure date.
There may be times that certain facilities or services may be
unavailable or limited due to unforeseen circumstances and Fontana
Travel cannot accept responsibility.
3. Bookings
A booking is deemed binding when Fontana Travel receives the
required deposit from the holidaymaker. An official Fontana Travel
availability confirmation invoice will be sent via E-mail. It is the
holidaymaker’s responsibility to check that all details are correct.
All personal information disclosed to Fontana Travel is held in
complete confidentiality however Fontana Travel reserves the right
to forward database information to third party organisations. The
person named on the Fontana Travel booking form is solely
responsible for paying all fees.
4. Late Bookings
Fontana Travel views a late booking as a booking enquiry made
within 30 days of intended arrival date. In the case of a late
booking been confirmed, payment of the full amount must be received
within 48 hours of the availability confirmation invoice being sent.
If the payment is not received the booking will be deemed cancelled.
5. Standards
Please note it is local national regulations and standards which
apply to any services provided and not those of your country of
residence. The monitoring, enforcement and compliance with such
regulations and standards is the responsibility of the local
national authorities concerned and the service supplier. Liability
insurance requirements vary considerably from country to country, as
do the responsibility placed on organisations by law.
6. Health and safety
We would advise that you take all reasonable precautions to
protect yourself and all members of your party. You should
familiarise yourself with fire-escape routes immediately on arrival.
In certain respects local national safety standards may differ to
those of your country of residence. Fontana Travel cannot accept any
responsibility for any accidental injuries or deaths.
7. Disabled Travellers
Fontana Travel aims to provide a high level of service to all
holidaymakers. However the village accommodation offered is not
equipped to cater for the needs of disabled holidaymakers. Fontana
Travel cannot be held responsible for any difficulties encountered
due to the unsuitability of any accommodation or service provided.
We strongly recommend if you have a serious medical condition or
disability that you seek advice from a specialist Tour Operator.
8. Holidaymakers' obligations
Holidaymakers are required to:
- Have valid travel documents and insurance.
- Obey the customs, laws and regulations of the Republic of Croatia.
- Obey villa rules and in general to have good relations with the
host.
- Understand that Fontana Travel is not responsible for the actions
undertaken by the village accommodation owners.
9. Cancellations and changes made by the
holidaymaker
Should the holidaymaker wish to alter a reservation, this must
be done via E-mail to Fontana Travel. Changes to a confirmed booking
may be requested, but cannot be guaranteed. In the event of
different village accommodation being selected to the one already
booked, then an additional 10% charge of the total existing booking
cost will represent an administration charge.
The holidaymaker may cancel the booking at any time prior to
arrival. Cancellation charges will be incurred and are charged as
follows:
0 – 7 days, 100% of total cost
charged
7 – 14 days, 70 % of total
cost is charged
14 to 30 days, 50 % of total
cost is charged
30 days and over, Loss of deposit
10. Fontana Travel's rights to changes and
cancellation
Fontana Travel reserves the right to change or modify a booking
in cases of circumstances caused by conditions beyond its control
that cannot be predicted, avoided or rectified or any circumstances
of Force Majore, (where possible in consultation with the
holidaymaker). Village accommodation booked may be substituted, by
Fontana Travel, only with village accommodation of the same or
higher category in the event of circumstances beyond its control.
In cases where substitute accommodation is not available Fontana
Travel reserves the right to cancel the booking, upon notification
of the holidaymaker and guarantees a full refund of moneys paid to
Fontana Travel within 30 days of intended departure date.
11. Insurance
Fontana Travel does not provide any form of travel insurance. We
strongly recommend that each holidaymaker obtains a travel insurance
policy and medical cover as Fontana Travel cannot be held
responsible for any subsequent insurance claims.
12. Complaints
In the event that the holidaymaker is dissatisfied with the
village accommodation or services provided it is the duty of the
owner of the village accommodation or service provider to rectify
the problem as they see fit.
If you are dissatisfied with the village accommodation or service
provided then you must report this to Fontana Travel immediately
as any complaint received after the departure date is beyond Fontana
Travel's control.
Fontana Travel is unable to compensate a holidaymaker for any
dissatisfaction as its services are provided in good faith.
13. Payments
Upon receipt of the availability confirmation and invoice e-mail
a deposit of 40% of the total amount is required to secure the
booking. Fontana Travel does not consider the contract to be binding
until the deposit is received by Fontana Travel (payment details are
set out on the availability confirmation invoice e –mail).
Deposit/Payments must be confirmed by Faxing or E-mailing the bank
transfer confirmation slip within 48hrs from availability
confirmation and invoice e-mail being sent.
Remaining balance of booking must be paid 30 days prior to arrival
date.
If the arrival date is less than 30 days at time of booking full
balance must be paid within 48 hrs of the availability confirmation
and invoice e-mail being sent.
Note
Upon payment of deposit, it is understood that the
holidaymaker named on the booking form and all persons in the party
accept the general term and conditions of Fontana Travel in their
entirety.
